The former personal attorney for Donald Trump has left her position as the chief federal prosecutor in the state. This follows a legal ruling that invalidated her legal standing to hold the office.

Official Departure

The head of the Justice Department, Pam Bondi, accepted the prosecutor's departure on the start of the week. She commented that the judicial decision made it unworkable for Habba to effectively run her office.

"Do not interpret following the order as giving up," Habba stated. "This battle will now stretch across the nation."

Judicial Challenge

The departure follows closely on a federal appellate panel found that she had been unlawfully serving as the top prosecutor. This judgment is expected to impact many prosecutions in the Garden State.

The judicial panel declared that a temporary posting that did not receive confirmation by the US Senate ran afoul of the statute on vacant positions.

Ongoing Legal Battle

The Attorney General added that Habba will stay on at the DOJ as a high-level advisor. They intend to challenge the decision of the court's action, with hopes of a overturned decision.

On a social media platform, Bondi contended that the court "should not be able to override the executive's selection of lawyers entrusted with performing the primary duty of the administration of prosecuting crime."

She highlighted the prosecutor's work and pointed out that under her leadership, the state capital of Newark saw a one-fifth decrease in offenses. She also stated that the city of Camden recorded its first summer in half a century with no murders.

Background and Previous Role

Habba, first joined Donald Trump's lawyers in 2021. She later defended her client in his New York criminal case in 2024, when he was conviction on multiple felony counts of falsifying business records.

Prior to her appointment to the federal prosecutor position, Donald Trump had revealed he was selecting her as his presidential counsellor if re-elected, calling the lawyer as deeply loyal and a relentless legal advocate.
